Affiliate program terms

These terms (the "Affiliate Terms") set out the rules for participation in the affiliate program of the Yskra service operated by ••••••••••••••••• (the "Operator"). The affiliate program enables earning commissions on referred Users.

§1. Definitions

  1. Program — the affiliate program of the Yskra service.
  2. Affiliate — a natural person over 18 years of age, a legal person or organisational unit that has registered in the Program and accepted these terms.
  3. Affiliate link — a unique URL with a tracking parameter (e.g. ?ref=AFFILIATE_CODE), enabling attribution of a User to the Affiliate.
  4. Referred User— a person who registered an account in Yskra after clicking the Affiliate's Affiliate link (attribution: first click + 30-day cookie).
  5. Commission— the Affiliate's remuneration for Referred Users who made purchases in Yskra.
  6. Affiliate Balance — the amount of accrued and confirmed Commission available for payout.

§2. Conditions of participation

  1. An Affiliate may be an adult with full legal capacity or a legal person seated in the European Union (or in a country with the required double taxation treaties with Poland).
  2. Registration in the Program requires acceptance of the Affiliate Terms, the Yskra Terms of Service and the Privacy Policy.
  3. To receive Commission payouts, the Affiliate must:
    • provide true invoicing/billing data,
    • conduct business activity or be a natural person not conducting such activity (in Poland — income from a service contract treated as income from other sources, art. 20(1) of the PIT Act),
    • if annual income exceeds PLN 200,000 — be registered as a VAT taxpayer,
    • for Affiliates outside the EU — provide a certificate of tax residence (CFR-1 or equivalent).

§3. How the Program works

  1. After registration, the Affiliate receives a unique referral code and access to the Affiliate panel (/konto/affiliate).
  2. The Affiliate promotes Yskra using Affiliate links in a manner consistent with these terms (see §6 — prohibitions).
  3. When a new User clicks the link, the system records attribution for 30 days in a cookie and in the database.
  4. When the Referred User makes a purchase within the attribution period, the Affiliate receives a Commission of:
    • 20% of the net valueof the Referred User's first purchase,
    • 10% of the net value of subsequent purchases by that User over the next 12 months from the date of registration.
    Current Commission rates are visible in the Affiliate panel. The Operator reserves the right to change rates with 30 days' notice.
  5. A Commission is confirmed 14 days after the transaction (accounting for refunds and chargebacks).

§4. Commission payouts

  1. Payouts are made at the Affiliate's request when the Balance is at least PLN 200 net.
  2. Payouts are made by bank transfer to the indicated account within 14 working days of receipt of a properly issued invoice/bill.
  3. The Affiliate is solely responsible for tax settlements (PIT/CIT/VAT) related to the Commissions received, in accordance with the law of their tax residence. The Operator does not act as PIT payer unless this duty arises directly from the law.

§5. Inactive Balance and expiry

Affiliate accounts that have not generated any Commission for 12 months and show no activity (logins, link clicks) are marked as inactive. Balances below PLN 200 not paid out within 24 months from the last activity expire — based on art. 5 of the Polish Act on Providing Services by Electronic Means and to avoid long-term liabilities of inactive accounts.

§6. Affiliate obligations and prohibitions

The Affiliate is prohibited, in particular, from:

  1. clicking their own Affiliate link and self-referrals, and creating fake accounts,
  2. using spam (e-mail, SMS, social media), unauthorised bulk mailings, malware,
  3. using cookie stuffing(forcing clicks without the user's knowledge),
  4. using brand bidding in paid search (Google Ads, Bing Ads) on keywords "iskra", "iskra ai", Yskra domain and variations misleading as to identity,
  5. publishing ads in contexts inconsistent with the law or unacceptable for the brand:
    • sites targeted at children, pornographic content depicting minors,
    • sites promoting violence, terrorism, hate speech,
    • illegal pirated content, unlicensed gambling, drugs,
    • sites infringing others' copyrights and trademarks.
  6. making misleading statementsabout the nature of the Service (e.g. "Yskra is dating with real women") — all characters are fictional and AI-generated and must be communicated truthfully,
  7. making outcome promisesabout AI conversations guaranteeing results (no "guaranteed match", "real girlfriend").

§7. Breach of the Terms

  1. Breach of the prohibitions in §6 results in:
    • blocking the Affiliate account,
    • revocation of unpaid Commission,
    • in serious cases — claims for damages.
  2. The Operator reserves the right to verify all conversions (traffic analysis, fraud detection) and to reject Commissions obtained in a manner inconsistent with these terms.

§8. Termination and changes

  1. Either party may terminate participation in the Program with 30 days' notice by e-mail. After termination, the Balance is paid out to the Affiliate (if above the minimum amount) and Affiliate links are deactivated.
  2. The Operator may change the Affiliate Terms. Changes take effect 30 days after their publication. The Affiliate has the right to terminate participation in connection with the change.

§9. Complaints

Complaints concerning Commissions, statistics and payouts are filed in accordance with the procedure described in /reklamacje.

§10. Final provisions

  1. In matters not regulated by the Affiliate Terms, the provisions of the Yskra Terms of Service, the Civil Code and Polish law apply.
  2. The competent court is the court for the Operator's seat.
